Certificate Course on Construction Contracts and Disputes

The Society of Construction Law India, in collaboration with the Centre for Law & Urban Development (CLUD), National Law University Delhi, is pleased to present a two-day Certificate Course on Construction Contracts and Disputes, scheduled for 9–10 May 2026 at National Law University Delhi.

As infrastructure development accelerates across India—spanning highways, metro systems, airports, and smart cities—the legal ecosystem surrounding construction projects is becoming increasingly intricate. Construction law today is not confined to contract interpretation; it requires an understanding of project lifecycles, risk engineering, regulatory frameworks, and dispute management. This course is designed to respond to that need by offering a focused, practice-oriented introduction to the field.

About the Course

India’s ongoing infrastructure expansion has brought construction law to the forefront as one of the most dynamic and demanding areas of legal practice. Projects are no longer linear undertakings—they involve multiple stakeholders, layered contractual arrangements, strict timelines, and high financial exposure. In such an environment, disputes are not exceptions but recurring features, often arising from delays, variations, cost escalations, and risk misallocation.

Despite this complexity, many legal professionals enter the field without a structured understanding of how construction projects operate in practice. This course seeks to bridge that gap.

The programme introduces participants to the full lifecycle of construction projects—from conceptualisation and contracting to execution and dispute resolution. It begins with an overview of the construction industry and its governing legal framework, situating contractual obligations within the broader regulatory and commercial context. Participants will then engage with the structure and negotiation of construction contracts, including different contracting models such as EPC, turnkey, and item-rate contracts, alongside the principles that govern effective risk allocation.

A key component of the course is its focus on international standard forms, particularly FIDIC and NEC contracts, and their interaction with Indian legal practice. Participants will develop an understanding of how these frameworks allocate risk, structure obligations, and manage project execution.

The course further explores claims management and delay analysis, equipping participants with the tools to identify, assess, and substantiate construction claims. It also emphasises the importance of documentation, project records, and proactive dispute avoidance strategies.

Finally, the programme examines the spectrum of dispute resolution mechanisms in construction law, including arbitration, adjudication, mediation, and court intervention. Participants will gain insight into procedural considerations, enforcement challenges, and strategic decision-making in dispute resolution.

The course culminates in a comprehensive practical exercise, where participants will analyse a simulated construction dispute, identify legal and contractual issues, evaluate risk allocation, frame claims or defences, and propose appropriate dispute resolution strategies.
